1 | Who is collecting your personal data?


This is the privacy notice of Artmaker International (hereinafter referred to as "AMI", "we", or "us"). AMI may collect your personal data when you engage our services, when we produce photographic or video content for or of you, when you contact us, or when you visit our website.

We may also obtain your personal data from other sources, such as public websites or our business partners. In all these cases, this privacy notice applies, and AMI is the data controller of your personal data.

In this notice, we explain how we handle your personal data in a careful and secure manner. We outline when we collect which types of personal data, how long we retain it, and how you may exercise your rights. It is important that you are informed of this.

For any questions, comments, or complaints regarding this privacy notice or the way we use your personal data, please contact us using our contact form. In some cases, such as in an employment context, you may need to contact your employer instead.


2 | What personal data is collected, why, and how long is it stored?

Provision of services: photography and videography
When you engage us to provide services such as photography, videography, or related creative services, we may collect personal data.


This includes:
 

  • Personal data of the individual with whom we communicate in the context of the services, which is necessary to conclude or perform the agreement. AMI is the controller for this data.

  • Personal data of individuals who appear in the photo or video materials, such as facial features and voice. These individuals may be employees of our client or attendees at an event organised by our client. In such cases, our client is the controller and is responsible for properly informing you and, where necessary, obtaining your written consent.
     

AMI may also ask for your written consent to use the footage for our own (promotional) purposes. In that case, AMI is the controller.

We may collect the following personal data for the above purposes:
 

  • Full name

  • (Business) address

  • (Business) phone number

  • (Business) email address

  • (Business) payment information, such as bank account number

  • Image and audio recordings, including appearance and voice

  • Any other personal data provided to us for the execution of our services
     

Your personal data is stored for the duration of the agreement and up to 2 years thereafter, unless we receive a deletion request earlier. However, deletion may not be fully possible if we are required to retain data for legal obligations, e.g. Dutch tax laws require financial and administrative records to be kept for 7 years.

Website management and contact requests

When you visit our website, we process your personal data through the use of cookies or similar technologies. We only use functional and analytical cookies to collect data about your website usage. If personal data is collected through these cookies, we rely on our legitimate interest to ensure proper website functionality and security.

We also process personal data when you contact us via the website, email, phone, or social media. This is based on our legitimate interest in responding to your request in a timely and appropriate manner.


We may collect the following personal data:

  • Technical data such as IP address collected via cookies

  • Any other data you provide, e.g., via the contact form
     

We retain this data for as long as is necessary to respond to your request. Cookie retention periods can be checked in your browser:
 

  • Press F12 or right-click and select “Inspect”

  • Go to the “Application” tab

  • Click on “Cookies” under “Storage” to view cookie names and retention periods.
     

Marketing communications

We may send newsletters, emails, or promotional messages to inform customers and interested parties about developments, offers, or changes to our services.
If you are an existing customer, we may use your contact details for such communications based on our legitimate interest. You may object at any time via email or unsubscribe using the link in each message. If you are not a customer but would like to receive updates, we will only do so with your consent, such as through website sign-up.


We may collect:

  • (Business) phone number

  • Subscription preferences and interests

  • Subscription and unsubscription dates
     

We retain your data for marketing purposes until you unsubscribe or object. If you are no longer a customer, we will stop sending communications no later than 3 years after our last contact.

3 | Who receives your personal data?

To provide our services, we may share your personal data with third parties. Some of these parties (e.g. software providers) act solely as data processors on our behalf under a data processing agreement and may only process your data in accordance with our instructions.
Your personal data is stored within the European Union.


Additionally, AMI may share your data with:
 

  • Affiliated companies, if necessary for the purposes set out in this notice and with a valid legal basis

  • Other third parties if necessary for the execution of a project or service (e.g. partners)

  • Other recipients where legally required, such as under a court order, legal process, regulatory request, or in the context of a merger, acquisition, or bankruptcy
     

Our website may contain links to third-party platforms like Instagram, Facebook, and TikTok. Clicking these may enable cookies (including advertising pixels) from third parties, which may collect data on your browsing habits and serve personalised ads. Please review the privacy and cookie policies of these third parties before using such links.

4 | How is your personal data protected?

We take the protection of your personal data seriously and implement appropriate technical and organisational measures to prevent misuse, loss, unauthorised access, and disclosure.
We use security software and technical safeguards such as firewalls. If you notice or suspect a security incident, please contact us immediately via our contact form.
Although we carefully select external links, we are not responsible for the data handling practices of third-party websites. We encourage you to read their privacy policies.


5 | What are your rights?

You have the following rights under applicable data protection law:

- Right of access and information
You may request information about our processing of your personal data, the recipients, and obtain a copy.

- Right to rectification
You may request correction or completion of inaccurate or incomplete data.

- Right to erasure ("right to be forgotten")
You may request erasure of your data if no longer necessary or processed unlawfully. We may retain data where legally required or where legitimate interests outweigh your request.

- Right to restrict processing
In certain cases (e.g., data inaccuracy or unlawful processing), you may request temporary restriction of processing.
Notification of rectification/erasure/restriction
We will notify recipients of your data about any corrections, deletions, or restrictions unless doing so is impossible or involves disproportionate effort.


- Right to data portability
Where applicable, you may request to receive or transfer your data in a structured, commonly used, machine-readable format.

- Right to object
You may object to processing based on legitimate interests or for direct marketing purposes. We will evaluate your objection and cease processing if justified.

- Right to withdraw consent
If we rely on your consent, you may withdraw it at any time. Withdrawal does not affect prior lawful processing.

- Right to lodge a complaint

To exercise your rights, contact us via our contact form. To protect your privacy, we will take steps to verify your identity before acting on your request (e.g. by confirming your name or email). Only you or someone legally authorised to act on your behalf may submit such a request.

We aim to respond within one month. If more time is needed (up to two months), we will inform you within the initial month. Requests are free of charge unless excessive or unreasonable. We may charge a reasonable fee for additional copies of your data.

AMI reserves the right to amend this privacy notice. We recommend checking this webpage regularly. If we make significant changes, we will notify you via email or a notice on our website.
